Notice is hereby given that a special meeting of the Town of Colonie Industrial Development Agency shall be held on Monday, April 23, 2018 at 6:00 p.m. at the Town of Colonie Public Operations Center, 347 Old Niskayuna Road, Latham, New York 12110, first floor conference room.

NOTICE OF PUBLIC HEARING

ON PROPOSED PROJECT AND GRANTING OF FINANCIAL ASSISTANCE

Notice is hereby given that a public hearing pursuant to Section 859-a(2) of the General Municipal Law of the State of New York (the “Act”), will be held by the Town of Colonie Industrial Development Agency (the “Agency”), on April 23, 2018, at 6:00 p.m. in the first floor conference room at the Town of Colonie Public Operations Center, 347 Old Niskayuna Road, Latham, New York, in connection with the following matter:

Starlite Associates, LLC, on behalf of itself and entities formed or to be formed on behalf of the foregoing (the “Company”), has presented an application (the “Application”) to the Agency requesting that the Agency consider undertaking a project (the “Project”) consisting of the following: (A)(1) the acquisition of an interest in approximately 20 acres of land located at 629 Columbia Street Extension in the Town of Colonie, Albany County, New York (the “Land”), (2) the construction of an approximately 149,005 square foot building (the “Facility”), and (3) the acquisition and installation therein and thereon of various machinery and equipment (the “Equipment”) (the Land, the Facility and the Equipment being collectively referred to as the “Project Facility”), such Project Facility to be leased to The Ayco Company, L.P. (“Ayco”), for use by Ayco as a new office complex and corporate headquarters; (B) the granting of certain “financial assistance” (within the meaning of Section 854(14) of the Act) with respect to the foregoing, including potential exemptions from mortgage recording taxes (except as limited by Section 874 of the Act), real estate transfer taxes, sales and uses taxes and real property taxes (collectively, the “Financial Assistance”); and (C) the lease (with an obligation to purchase) or sale of the Project Facility to the Company or such other person as may be designated by the Company and agreed upon by the Agency.


The Company will be the initial owner of the Project Facility and Ayco will be the initial operator of the Project Facility.

The Agency will at said time and place hear all persons with views on the granting of the Financial Assistance.

A copy of the Application, which provides further details regarding the Project and the Financial Assistance requested by the Company, is available for public inspection during business hours at the offices of the Agency located at 347 Old Niskayuna Road, Latham, New York 12110.

The Ayco Company, L.P., on behalf of itself and entities related to or formed or to be formed on behalf of the foregoing (the “Company”), has presented an application (the “Application”) to the Agency requesting that the Agency consider undertaking a project (the “Project”) consisting of the following:  (A)(1) the construction of tenant buildout and fit-up improvements (the “Tenant Improvements”) in an approximately 149,005 square foot building (the “Facility”) to be constructed by Starlite Associates, LLC (“Starlite”) on certain real property located at 629 Columbia Street Extension in the Town of Colonie, Albany County, New York (the “Land”), and (2) the acquisition and installation therein and thereon of various machinery and equipment (the “Equipment”) (the Land and the Facility being collectively referred to as the “Project Facility” and the Tenant Improvements and the Equipment being collectively referred to as the “Tenant Project Facility”), such Project Facility and Tenant Project Facility to constitute a new office complex and corporate headquarters; (B) the granting of certain “financial assistance” (within the meaning of Section 854(14) of the Act) with respect to the Tenant Project Facility, including potential exemptions from sales and use taxes (the “Financial Assistance”); and (C) the lease (with an obligation to purchase) or sale of the Tenant Project Facility to the Company or such other person as may be designated by the Company and agreed upon by the Agency.

 

Starlite will be the initial owner of the Project Facility, the Company will be the initial operator of the Project Facility and the Company will be the initial owner of the Project Facility and the Tenant Project Facility.

 

The Agency will at said time and place hear all persons with views on the granting of the Financial Assistance.
